DECISION

The applicant makes application for amnesty in terms of Act 34 of 1995 as amended ("the Act") in respect of possession, dealing and the distribution of firearms and ammunition in contravention of the laws relating to Arms and Ammunition in the Republic of South Africa committed during the period August 1990 and December 1993.
It seems that he was a member of a Self Defence Unit (SDU) in Thokoza, established by the mechanisms within the structures of the African National Congress (ANC) and for the purpose of protecting members of the community in the general area and in
particular those who had links to the ANC and being attacked by members of other political parties.
As part of his duties he purchased, took into possession and distributed firearms and the associated ammunition to other members of the SDU. He purchased the firearms and ammunition with money provided to the SDU by the community. Clearly his actions were politically based and he has disclosed the relevant facts pertaining to the offences for which he applies for amnesty.
We are satisfied that he has complied with the requirements of the Act and consequently amnesty is GRANTED to him for the offences of purchasing, possessing and distributing firearms and ammunition in contravention of the laws relating to Arms and Ammunition.
