DECISION
This is an application for amnesty in terms of the provisions of Section 18 of the Promotion of National Unity and Reconciliation Act No.34 of 1995 ("the Act"). The matter relates to the offence of high treason committed by the Applicant during or about the period September 1984. The particular offence constituted the subject matter of a high profiled political trial that was held at Delmas in the present province of Gauteng. At the conclusion of the trial, the Applicant was acquitted.
The full facts and circumstances of the matter appear from the various judgments of the then Transvaal Provincial Division of the Supreme Court which are available to us. No purpose would be served by summarising the same. Suffice it to say that there can be no doubt that the particular charge of high treason related to the political conflicts of the past.
Having carefully considered the matter, we are satisfied that the application complies with all of the requirements of the Act and amnesty is accordingly hereby GRANTED to the Applicant in respect of the offence of high treason committed during or about the period September 1984 in the then province of Transvaal.
