DECISION
The Applicant applied for amnesty in respect of various incidents which have all been finalised save for the present matter which is being dealt with in chambers.
Applicant's personal circumstances and activities as a political leader have been dealt with in the matters which had already been finalised and no useful purpose would be served by repeating them.
The present decision relates to an incident which occurred on 22 April 1993 at the offices of the Citizen Newspaper in Pretoria when the Applicant assaulted two of the newspaper's journalists and also committed the offences of malicious injury to property and crimen injuria. Applicant was apparently upset by an article which appeared in the newspaper earlier that day.
Applicant was subsequently convicted of assault, malicious injury to property and crimen injuria pursuant to the incident and sentenced to a fine on 12 July 1993.
Having considered the matter, we are not satisfied that the incident constituted an act associated with a political objective as envisaged in Act 34 of 1995 ("the Act"). The application accordingly does not comply with the requirements of the Act and amnesty is REFUSED.
