This is an application for amnesty in terms of Section 18 of the Promotion of National Unity and Reconciliation Act of 1995. The applicant, Gayo Jabulani Walter Nxumalo, is a former member of Umkhonto weSizwe ("MK"), the military wing of the African National Congress ("ANC"). He was convicted for Terrorism and Sabotage committed in 1977 and he was sentenced to twenty (20) years imprisonment. He has completed serving his sentence. He desires that his criminal record following a conviction in June 1988 be expunged (see Prison No. 36/88).
Having considered this application the Amnesty Committee is satisfied that the applicant is entitled to amnesty. Accordingly his application succeeds for the following offences:-
1. Terrorism;
3. all other offences connected to and arising from the incidents for which the applicant applies for amnesty.
The relevant authorities are requested to expunge the previous conviction from the State records.
