DECISION

The applicants applied for amnesty for the killing of Ernest Ramango, an alleged police informer known as Bron 405 in or about 1987/1988.

The first applicant informed inter alia the second and the third applicant that subsequent to his interrogation of Ramango he had become convinced that Ramango was a double agent and that because of the political conditions prevailing at the time, it had become necessary to eliminate him. During Ramango's interrogation, the second applicant participated in his assault. The first applicant gave Ramango a cooldrink laced with sleeping pills to drink and shortly thereafter Ramango was rendered unconscious thereby. The first applicant instructed both applicants to put the unconscious Ramango into the of the car.

Later that day the second applicant was instructed to drive the car to the direction of Mamelodi. At a certain spot near Mamelodi East he was instructed to stop the car and the third applicant, and other security police present thereat were instructed to carry the still unconscious Ramango out of the car.

The first applicant was in possession of explosives which he had brought with him to the scene. The first applicant then instructed the third applicant as well as the other security police presence thereat to assist him to place the explosives around the body of Ramango. He thereafter detonated the explosives, thereby killing Ramango and destroying his body.

Having considered all the evidence before us we are satisfied that the second and third applicant participated in the gruesome killing of Ramango under the instructions of the first applicant who was in command of their unit, consequent by their participation in the killing of the late Ernest Ramango and in the desecration of his body are acts associated with a political objective as defined in the Act.

It is our view that the applicants have complied with the requirements of section 20(1) of the act and amnesty is hereby GRANTED to the second applicant for the following:-

1. the assault on Ernest Ramango with an intention to do grievous bodily harm.

2. the murder of Ernest Ramango

3. the desecration of Ramango's body.

Amnesty is GRANTED to the third applicant for:-

1. the murder of Ernest Ramango

2. the desecration of Ramango's body.

We reserve judgment in respect of the late Sarel Du Plessis Crafford's application.
