AC/2001/131
TRUTH AND RECONCILIATION COMMISSION
AMNESTY COMMITTEE
APPLICATION IN TERMS OF SECTION 18 OF THE PROMOTION OF NATIONAL UNITY AND RECONCILIATION ACT, NO.34 OF 1995.
JAN WILLEM JANSE VAN RENSBURG APPLICANT
(AM 5666/97)
DECISION
In his application for amnesty the Applicant appears to have intended to apply for amnesty for a whole range of unspecified acts. Only one act is specified in detail namely the training and advice to members of the Inkatha Freedom Party ("IFP") at Entabene in or about 1993. The Applicant was afforded an opportunity to clarify his application and to specify any other acts, omissions or offences but he failed to respond.
On the papers before the Committee, we are satisfied that the Applicant meets with the formal requirements for the granting of amnesty in respect of his participation in the unlawful military training of members of the IFP. The Committee is further satisfied that this was an act associated with a political objective in the course of the conflicts of the past and that the Applicant has made a full disclosure of all relevant facts relating thereto.
Accordingly amnesty is GRANTED to Jan Willem Janse Van Rensburg for offences directly associated with the unlawful military training of members of the IFP at Entabene in or about 1993.
DATED AT CAPE TOWN THIS DAY OF 2001.
