DECISION
The Applicant applied for amnesty in respect of 86 incidents. For the sake of convenience the incidents will be listed below as it appeared in his application. At the end of this decision reference would be made to incidents heard by other Amnesty Panels and the decision reference numbers.

DEALING WITH THE INCIDENTS
Incidents 3, 5, 15, 26 and 27 were dealt with at a hearing by another Amnesty Committee Panel and the decision was handed down as AC/2001/005. Applicant was also granted amnesty in AC/1999/242 in respect of his involvement in the Khotso House incident.
Many of the incidents mentioned by the Applicant were of the same nature. The same pattern was followed. He was a member of the South African Police, attached to the Witwatersrand Security Branch and was a field operative attached to the White Desk. His functions included the monitoring, harassment and intimidation of persons and institutions believed to be actively opposed to the government.
The Panel of the Amnesty Committee sitting at JISS Centre, Johannesburg from 27 November 2000 onwards was asked to deal with incidents 2, 19, 67, 68 and 74 and the decision was handed down as AC/2001/230.
The other incidents referred to herein were considered to be chamber matters which could be disposed of without a hearing in terms of Section 19 of Act 34 of 1995.
This Committee will now deal with the remaining incidents after considering the evidence and information supplied by the Applicant and any further information gathered by investigators of the TRC, and evidence given at hearings of the Human Rights Violations Committee of the TRC.
These acts were committed while the Applicant was acting in his capacity as a policeman under either the specific or general orders given by his superior officers. He, at the time, believed he was tormenting enemies of the State and that in so doing was promoting the interests of the State. In incidents where we are not satisfied that this was the position, the Committee will state its viewpoint and the reasons therefore.
Amnesty is GRANTED to the Applicant in respect of offences and delicts mentioned and directly linked with the following incidents mentioned above.
Amnesty is GRANTED in respect of the following incidents (as qualified in respect of incidents 21, 54 and 55):
1, 4, 6, 7, 8, 9, 10, 11, 12, 13, 14, 16, 17, 18, 20, 21, 22, 23, 24, 28, 29, 30, 31, 32, 33, 34, 35, 36, 37, 38, 39, 40, 41, 42, 43, 45, 46, 47, 48, 49, 50, 51, 53, 54, 55, 56, 57, 58, 59, 60, 61, 64, 65, 66, 69, 70, 72, 73, 78, 84.
Amnesty is REFUSED in respect of the following incidents:
1. INCIDENT 21 - in respect of the stealing of plants because that involved personal gain;
2. INCIDENT 25 - because it does not relate to "our struggle of the past" as contemplated in Act 34 of 1995;
3. INCIDENT 44 - because it was not an offence or delict in terms of the then prevailing law;
4. INCIDENT 52 - no offence or delict;
5. INCIDENT 54 - in respect of theft that was for personal gain;
6. INCIDENT 55 - in respect of theft that was for personal gain;
7. INCIDENT 62 - because it was for personal gain;
8. INCIDENT 63 - because it was authorised by legislation;
9. INCIDENT 71 - no offence or delict;
10. INCIDENT 76 - no offence or delict;
11. INCIDENTS - 75, 77, 79, 80, 81, 82, 83, 85 because it is neither an offence or delict;
12. INCIDENT 86 - for personal gain.
